These Terms of Service ("Terms") govern your access to and use of PersonaForge ("the Service"), operated by M3T Labs ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use PersonaForge. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access. We strongly recommend enabling multi-factor authentication (MFA), which is required before uploading biometric data.
3. The Service
PersonaForge allows you to create AI personas by uploading photos, voice recordings, and written content. We use this data to generate a 3D avatar, cloned voice, and trained personality model that you can deploy as a conversational AI agent.
4. Your Content and Data
You retain ownership of the content you upload (photos, voice recordings, text). By uploading content, you grant us a limited, non-exclusive license to process, store, and transform that content solely for the purpose of providing the Service.
You represent and warrant that you have the right to upload all content you provide, and that such content does not infringe any third party's rights. If you create a persona using another person's likeness, you must obtain their consent through our platform's consent verification process.
We use service providers to operate PersonaForge; the categories are described in our Privacy Policy, and their identity is available on request at legal@persona-forge.ai.
5. Biometric Data
The Service processes biometric data (facial geometry and voiceprints) as part of persona creation. By using the Service, you acknowledge that you have read and agreed to our Biometric Data Policy and have provided informed consent for the collection and processing of biometric data.
6. Prohibited Uses
You agree not to use the Service to:
- Create personas that impersonate real people without their consent
- Generate deepfakes, misinformation, or deceptive content
- Harass, abuse, threaten, or harm others
- Violate any applicable law or regulation
- Attempt to reverse-engineer, decompile, or extract our AI models
- Circumvent security measures or access controls
- Use the Service for any illegal or fraudulent purpose
7. Intellectual Property
The Service, including its design, code, AI models, and branding, is owned by M3T Labs and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.
8. Pricing and Payments
Certain features of the Service may require a paid subscription. Pricing details are available on our website. We reserve the right to change pricing with 30 days notice. Refunds are handled on a case-by-case basis.
9. Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your personas will be deactivated and your data will be deleted in accordance with our Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, M3T LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance.
13. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Subject to the small-claims exception below, you and M3T Labs agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service is the state courts of the State of California and the United States District Court for the Northern District of California, and each party consents to personal jurisdiction there. Either party may instead bring an individual action in small claims court in the county where you reside. If you reside outside California, nothing in this section waives any non-waivable consumer protection rights available to you under the law of your home jurisdiction.
